1. Agreement to Terms

These Terms and Conditions govern the use of SpeakYour.Site, a service operated by SC Design Studio LLC ("Company," "we," "us," or "our").

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and SC Design Studio LLC, governing your access to and use of the SpeakYour.Site website, voice-powered website creation service, and all related services (collectively, the "Service").

By accessing or using our Service — including by calling our phone number, visiting our website, or claiming a generated website — you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

SpeakYour.Site is a voice-first website creation platform designed for contractors and service-based businesses. Users call a designated phone number, describe their business verbally, and receive an AI-generated professional website. The Service includes:

  • Voice-to-website generation via AI
  • Website hosting on subdomains of speakyour.site
  • SMS delivery of website preview links
  • Subdomain claiming and custom domain support (paid plans)
  • Website editing and management tools
  • Email and SMS notifications

3. Eligibility

You must be at least 18 years of age and have the legal authority to enter into these Terms to use our Service. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

4. User Accounts

When you create an account or claim a website, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your login credentials secure and confidential
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorized access or use

We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe are being used in violation of these Terms.

5. Free and Paid Services

Our Service operates on a freemium model:

Free Tier:

  • Website generation via phone call is free
  • Preview links are provided via SMS at no charge
  • Unclaimed preview websites may be removed after 24 hours

Paid Plans:

  • Paid plans are required to claim a subdomain and keep your website live permanently
  • Subscriptions are billed monthly in advance through Stripe
  • You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
  • Subscription fees are non-refundable except as required by applicable law
  • We reserve the right to change pricing with 30 days' notice to active subscribers

6. Voice Calls and Consent

By calling our service phone number, you acknowledge and agree that:

  • Your call will be answered by an AI voice assistant, not a human
  • Your voice input will be recorded, transcribed, and processed to generate website content
  • The information you provide will be used to create a publicly accessible website
  • You are responsible for the accuracy of the information you provide during the call
  • Call data may be retained for quality assurance, dispute resolution, and service improvement

7. SMS Communications

By providing your phone number and using our Service, you consent to receive SMS messages from us, including website preview links, account notifications, and service updates. Message and data rates may apply. You may opt out of non-essential messages by replying STOP at any time. Standard messaging terms apply.

SpeakYourSite SMS Program Terms

By providing your mobile phone number and opting in to receive text messages, you agree to receive transactional SMS messages from SpeakYour.Site related to your account, website generation, verification, and service updates.

Message frequency varies. Message and data rates may apply.

You may opt out at any time by replying STOP to any message. After you send STOP, you will receive a confirmation message and will no longer receive SMS messages from us unless you re-subscribe.

Consent to receive text messages is not a condition of purchase. Wireless carriers are not liable for delayed or undelivered messages.

8. AI-Generated Content

Websites created through our Service are generated using artificial intelligence. You acknowledge and agree that:

  • AI-generated content may contain errors, inaccuracies, or omissions
  • You are solely responsible for reviewing, editing, and approving all website content before and after publication
  • We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose
  • AI-generated images, text, and layouts are provided "as is" and may not perfectly reflect your business
  • You are responsible for ensuring your website content complies with all applicable laws and regulations, including advertising and licensing requirements specific to your trade

9. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international laws or regulations
  • Create websites containing false, misleading, or deceptive business information
  • Infringe upon the intellectual property rights of others
  • Create websites promoting illegal activities, violence, hate speech, or discrimination
  • Distribute malware, spam, or other harmful content
  • Impersonate another person or business
  • Misrepresent your licensing, certifications, or qualifications
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for any purpose other than creating legitimate business websites

We reserve the right to remove any website or suspend any account that violates these terms, at our sole discretion and without prior notice.

10. Intellectual Property

Your Content: You retain ownership of the business information, text, images, and other content you provide to create your website. By using our Service, you grant SC Design LLC a worldwide, non-exclusive, royalty-free license to use, host, display, reproduce, and distribute your content solely as necessary to provide and promote the Service.

Our Service: The Service, including its design, code, features, branding, and underlying technology, is owned by SC Design LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of our Service without our written permission.

Generated Websites: Website templates, layouts, and design elements generated by our AI are provided for your use as part of the Service. Your license to use the generated website is contingent on maintaining an active subscription. Upon cancellation or termination, your website may be taken offline.

11. Website Hosting and Subdomains

Websites created through our Service are hosted on subdomains of speakyour.site (e.g., yourbusiness.speakyour.site). You acknowledge that:

  • Subdomain availability is on a first-come, first-served basis
  • We reserve the right to reclaim, reassign, or remove subdomains that are inactive, misleading, or in violation of these Terms
  • We do not guarantee uninterrupted uptime, though we strive for high availability
  • Unclaimed preview websites are temporary and may be deleted at any time
  • We are not responsible for any business losses resulting from website downtime

12. Third-Party Services

Our Service relies on third-party providers including Vapi (voice AI), Google Gemini (content generation), Stripe (payments), Twilio (SMS), Resend (email), Supabase (database), and Vercel (hosting). We are not responsible for the availability, accuracy, or performance of these third-party services. Your use of features powered by these services is also subject to their respective terms and policies.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. SC DESIGN LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR NEEDS; (C) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS; OR (D) ANY DEFECTS WILL BE CORRECTED.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SC DESIGN LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR ANTICIPATED SAVINGS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

YOU SPECIFICALLY ACKNOWLEDGE THAT SC DESIGN LLC SHALL NOT BE LIABLE FOR DAMAGES ARISING FROM: (I) INACCURATE AI-GENERATED CONTENT ON YOUR WEBSITE; (II) YOUR RELIANCE ON THE SERVICE FOR BUSINESS-CRITICAL OPERATIONS; (III) UNAUTHORIZED ACCESS TO YOUR ACCOUNT; OR (IV) THIRD-PARTY SERVICE OUTAGES OR FAILURES.

15. Indemnification

You agree to indemnify, defend, and hold harmless SC Design LLC and its officers, directors, members, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) the content of your website; (c) your violation of these Terms; (d) your violation of any law or regulation; or (e) your violation of any third-party rights.

16. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, with or without cause, and with or without notice. Grounds for termination include but are not limited to violation of these Terms, non-payment, fraudulent activity, or extended inactivity.

Upon termination: (a) your right to use the Service ceases immediately; (b) your website may be taken offline; (c) we may delete your account data after a reasonable retention period; and (d) any outstanding payment obligations remain due.

17. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through binding arbitration or small claims court, at the election of the claiming party.

YOU AND SC DESIGN LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SC Design LLC regarding the Service. These Terms supersede all prior agreements, representations, and understandings, whether written or oral.

21. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on this page and updating the "Last updated" date. For active subscribers, we will provide at least 30 days' notice of material changes via email or SMS. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
